How the Divorce Process Works

Under the current system there’s a built-in timetable. Seatons will guide you through it and keep you updated.

  1. Application – we prepare and file a sole or joint application for you.
  2. 20-week period – the law builds in a 20-week period before you can move to the next stage. This is when many people sort out finances and children.
  3. Conditional Order – after 20 weeks the court can make the conditional order (the old “decree nisi”).
  4. 6-week period – you wait a further 6 weeks.
  5. Final Order – this is when the marriage is legally ended.

Important: The divorce itself does not automatically deal with the house, money or pensions. That has to be sorted separately, ideally with a financial / consent order. Seatons can do that for you.

How long does a divorce take now?

Because of the 20-week period and the further 6 weeks before the Final Order, the minimum is about 7 months – longer if finances or children aren’t agreed.

Does divorce sort the house out automatically?

No. You need a financial / consent order to make the money and property side final. We can draft that for you.

What if my name isn’t on the deeds?

If you’re married, you usually still have strong rights to occupy the home. Speak to us before you move out or agree to a sale.

Do I have to come into the office?
